These Terms of Service ("Terms") govern your access to and use of the website, products, and services provided by AWP ("we", "us", or "our"). By accessing our website or using our services, you agree to these Terms. If you do not agree, please do not use them.

1. Use of our services

You may use our website and services only for lawful purposes and in line with these Terms. You agree not to misuse the services, interfere with their normal operation, attempt to gain unauthorised access, or use them to infringe the rights of others.

2. Accounts and credentials

Where access requires an account or API credentials, you are responsible for keeping them secure and for all activity that occurs under them. Notify us promptly if you believe your credentials have been compromised.

3. Services and engagements

Custom software work is governed by a separate written agreement or statement of work that sets out scope, deliverables, timelines, and fees. Where those terms conflict with these Terms, the signed agreement prevails for that engagement.

4. Payments, subscriptions & mandates

• Fees are billed as described at checkout or in your agreement, and are processed through our payment gateway.
• For subscriptions, you authorise recurring charges (via a payment mandate) for the plan and any add-ons you select, until the subscription is cancelled.
• Recurring charges continue each billing cycle until you cancel. Cancellation stops future renewals; it does not retroactively refund the current cycle unless stated otherwise.
• Applicable taxes are added where required by law.

5. Refunds

Refunds, where offered, are handled according to the terms presented at purchase or in your agreement. If you believe a charge is in error, contact us at connect@awp.dev and we'll look into it promptly.

6. Intellectual property

Our website, brand, and the software we operate are protected by intellectual property rights. Ownership of custom work we build for you transfers as set out in the relevant agreement. You may not copy, resell, or reverse-engineer our services except as permitted by law or written agreement.

7. Third-party services

Our services rely on third parties (such as payment gateways, cloud hosting, and accounting tools). Your use of those services may also be subject to their terms, and we are not responsible for their acts or omissions.

8. Availability

We work hard to keep our services available and performant, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the services, and will give reasonable notice where practical.

9. Disclaimers

Except as expressly stated in a written agreement, our website and services are provided "as is" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, AWP will not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, data, or goodwill arising from your use of the services. Our total liability for any claim is limited to the amounts you paid us for the service giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "last updated" date above. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
